By reserving a charter or employing our Service, you consent to comply with these Terms. Should you reject any portion of the terms, you are not permitted to use the Service.

2. Service Overview

CommonsBeacon offers first-class yacht chartering services that include, without limitation:

  • Daily yacht charters
  • Evening cruises
  • Business retreats
  • Personalized celebrations
  • Multiple-day charters

Service provision is contingent upon availability and weather circumstances. We hold the right to alter or cease any service without prior notice.

3. Booking and Reservations

3.1 Booking Procedure

For a charter reservation, you are required to:

  • Have a minimum age of 18 years
  • Submit precise and full details
  • Make a payment for the necessary deposit as detailed in the booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking becomes definite only with the payment and our confirmation in writing. We maintain the right to decline service at our discretion.

3.3 Charter Availability

The availability of all charters is contingent on boat readiness and appropriate weather conditions. Efforts will be made to cater to your requested dates and time slots.

4. Payment Terms

4.1 Costs

All service fees are quoted in € and include all relevant taxes unless specified otherwise. Fees are subject to change with no advance notice.

4.2 Payment Timeline

  • Deposit: 50% of the complete cost of the charter is due upon reservation
  • Remaining balance: Required 48 hours prior to the charter’s departure
  • Extra fees (if applicable): Due at the end of the charter

4.3 Methods of Payment

We accept various forms of payment such as major credit cards, wire transfers, and certified bank drafts, with secure and encrypted processing systems.

5. Cancellation and Refund Policy

5.1 Customer Initiated Cancellations

  • More than 72 hours prior to departure: Full refund excluding processing charges
  • 24 to 72 hours before departure: Refund of 50%
  • Less than 24 hours prior to departure: Non-refundable

5.2 Cancellations Due to Weather

If unsafe weather is determined by our captain, we will propose to:

  • Reschedule the charter to an upcoming slot with no extra charge
  • Issue a complete refund if rescheduling isn't an option

5.3 Mechanical Failures

In the rare occasion of technical malfunctions with the designated vessel, we will strive to supply an acceptable alternative. If that is not possible, a refund in full will be issued.

6. Safety and Behaviour

6.1 Safety Protocols

Every passenger must:

  • Adhere to all directives from the crew
  • Utilize safety gear when instructed
  • Disclose any health conditions that could impinge on their safety
  • Stay within the vessel’s designated areas

6.2 Forbidden Objects

The following articles are not allowed aboard:

  • Containers made of glass
  • Unlawful materials
  • Guns or other weaponry
  • Tobacco Products
  • Animals (except if pre-approved)

6.3 Conduct Rules

Passengers are expected to behave in a considerate manner. A charter may be terminated prematurely without a refund if a passenger's conduct endangers safety or mars the experience of others.

7. Liability and Insurance

7.1 Our Responsibility

We limit our liability to the amount paid for the charter. We are not culpable for:

  • Bodily harm due to passenger carelessness
  • Loss or damage of personal belongings
  • Non-direct, consequential, or penal damages
  • Delays engendered by weather or factors beyond our governance

7.2 Insurance

We hold a comprehensive marine insurance that covers our vessels and operating procedures. Passengers must ensure their own travel and personal insurance coverage.

7.3 Accepting Risks

By partaking in our charter services, you accept that maritime activities are inherently risky and you are assuming full personal responsibility for your safety and welfare.

8. Changes to Itineraries

We preserve the right to change itineraries, routes, or timetables due to weather conditions, safety concerns, or operational necessities. We will do our best to propose comparable alternatives when possible.

9. Uncontrollable Circumstances

Our accountability does not extend to delays, cancellations, or variations caused by events outside our control, including but not restrained to:

  • Extreme weather conditions
  • Natural catastrophes
  • Governmental edicts
  • Harbor shutdowns
  • Vessel mechanical issues

10. Privacy and Data Protection

Your private data is managed following our Privacy Policy. Engagement with our services indicates your agreement to our collection and usage of your information as outlined in our Privacy Policy.

11. Intellectual Property

All material on our website, including words, graphics, trademarks, and images, is safeguarded by copyright and laws. You may not copy, distribute, or create derivative pieces without our authorization in writing.

12. Governing Law

These Terms are submitted to the laws of Germany. Any conflict shall be settled in the courts of Hamburg, Germany.

13. Revisions to Terms
